🚭 Spain Plans Smoking Ban for Outdoor Public Spaces : New Law Could Ban Smoking and Vaping Outdoors Across Spain by 2027

Spain is preparing major changes to its tobacco regulations. A new draft law aims to ban smoking and vaping in many public outdoor spaces, expanding protections for non-smokers and aligning with European public-health standards.

The proposal has been approved by the cabinet and is now under parliamentary debate. If passed, the rules could take effect nationwide before 2027.

The draft legislation proposes smoke-free outdoor areas at:

Open-air events and entertainment venues

Areas around schools, hospitals and public buildings

The goal is to reduce passive smoke exposure in busy social areas where families, tourists and locals gather.

The law treats all nicotine products equally, including:

Health authorities argue this approach prevents confusion and protects non-smokers from second-hand exposure, regardless of the product being used.

💸 Fines for smoking in prohibited places start at €100 but can reach up to €600,000 in very serious cases.

🚫 Advertising and promotion of tobacco and vaping products are also restricted:

⭕ No logos or ads in bars, nightclubs, urban furniture, or terraces

⭕ Promotion only allowed inside tobacconists, not in shop windows or with posters

The law targets both traditional tobacco and electronic alternatives, including vapes, e-cigarettes, heated tobacco products, and nicotine pouches.

Spain’s indoor smoking ban from 2011 does not cover busy outdoor locations, where crowds can be exposed to smoke. Officials say legislation must evolve to match changing habits, especially with the rise in vaping among young people.

Health experts describe the reform as a “decisive opportunity” to protect the public and ensure the right to breathe clean air.

Bars, restaurants and nightlife businesses have criticised the proposal, saying it could:

Affect tourism, especially in warmer regions

Some business owners fear that smokers will move to surrounding streets or private spaces, potentially causing more litter and disturbances. Others warn the rule may require additional ashtrays or disposal points to prevent cigarette waste.

Spain follows a trend across Europe. France, introduced similar rules earlier this year, though it left terraces and e-cigarettes unrestricted. Europe still has high smoking rates, with one in four adults smoking.

The draft law does not yet include plain packaging or tax hikes, unlike 25 other countries. However, the government may revisit plain packaging as the bill moves through parliament.

As of December 2025, the proposed legislation is still moving through parliament. Although it has received cabinet approval, it must still be debated and voted on before it can officially become law.

Meanwhile, regional authorities and public health groups continue to push for stronger measures, including possible limits on smoking on private balconies or close to residential properties.

If approved, the law is expected to be phased in gradually before 2027.
